1-Introduction

Carlota Leitão is the owner and responsible party for the website carlotaleitao.photo, through which she provides documentary, editorial and commercial photography services, as well as the sale of physical photographs as works of art. These Terms and Conditions govern access to and use of the website, the contracting of services and the purchase of products. By using the website or making a purchase, the client accepts the conditions described herein. Carlota Leitão operates under Portuguese law and complies with the applicable regulations on electronic commerce.

2. Photography Services

2.1 Scope of services

Carlota Leitão offers documentary, editorial and commercial photography services to private clients, businesses and publications. Projects may include reportage, portraits, archive photography, brand content, advertising campaigns, product photography and other work of a documentary, editorial or commercial nature, to be defined on a case-by-case basis.

2.2 Quotes and contracting

All projects are quoted individually based on the specifics of the work. The quote is sent by email and is considered accepted upon written confirmation by the client. Contracting may require the payment of a deposit, as agreed.

2.3 Copyright and licensing

The photographs produced are protected by the Copyright and Related Rights Code (CDADC). Unless otherwise agreed in writing, Carlota Leitão retains all copyright over the images.

The client receives a usage licence as defined in the quote or contract, which will specify:

  • Purpose: internal use, editorial, advertising, social media, etc.
  • Territory: national or international
  • Duration: authorised period of use
  • Exclusivity: when applicable and agreed

Any use of the images beyond the licensed scope requires prior and express authorisation, and may entail additional costs. The transfer, sublicensing or resale of the images to third parties without written authorisation is expressly prohibited.

2.4 Cancellations and amendments

Cancellation of a project must be communicated in writing. Should cancellation occur after work has begun, the proportional value of the work already carried out may be invoiced, as well as any expenses incurred. Changes to the scope of the project may require a revision of the quote.

3. Shop — Sale of Physical Photographs

3.1 Copyright and licensing

All photographs sold in the shop are protected by the CDADC and international copyright treaties. The purchase of a photograph grants the buyer the right of physical ownership of the work, but does not transfer copyright nor grant a licence for reproduction, distribution or commercial use. Any use beyond personal enjoyment requires the express authorisation of the author.

3.2 Product details

The photographs are printed on high quality materials and are available in different sizes, as indicated on each product page. Where applicable, limited editions are numbered and authenticated by the author. All photographs are sold unframed — framed images displayed on the website are for illustrative purposes only. Custom or made-to-measure orders must be requested by email.

3.3 Prices, payments and taxes

Payments are processed via PayPal. Prices are displayed in euros (€) and do not include VAT. VAT will be applied at the time of purchase in accordance with the applicable rules:

  • Portugal: standard rate of 23%
  • Other EU countries: the VAT rate of the buyer’s country may apply, under the OSS scheme
  • Outside the EU: the client may be responsible for import duties or local taxes applicable in their country

3.4 Shipping and delivery

We ship worldwide from Portugal. Estimated delivery times are:

  • Printing: 2 to 5 business days
  • Shipping to Portugal: 1 to 2 business days
  • International shipping: 4 to 6 business days

International orders may be subject to customs processes that affect delivery times. The client is responsible for compliance with local import regulations.

3.5 Right of withdrawal (returns)

The client may exercise the right of withdrawal within 14 days of receiving the product, provided it is in perfect condition and in its original packaging. Returns of personalised or made-to-order products are not accepted. To initiate the returns process, the client must contact us by email. Return shipping costs are the responsibility of the client, except in the case of a defect or error attributable to the seller.

3.6 Warranty and complaints

Should the product arrive damaged or defective, the client must notify us within 48 hours of delivery, sending photographs documenting the problem. We will proceed with a replacement or refund as appropriate.

4 Data protection

Personal data collected in the process of purchasing and contracting services is processed in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection legislation. Clients have the right to request access, rectification or deletion of their personal data. Data is not shared with third parties, except for the purposes of payment processing and order shipping.

5 General Provisions

5.1 Applicable law and dispute resolution

These Terms and Conditions are governed by Portuguese law. In the event of a dispute, clients may resort to the Alternative Consumer Dispute Resolution (ADR) mechanisms available in Portugal. For international disputes, we encourage resolution through recognised consumer protection organisations.

5.2 Changes to the terms

Carlota Leitão reserves the right to update these Terms and Conditions. Any changes will be published on this page with an indication of the update date.
